  1. 1.     Terms and Conditions

The Promoter of Caydoo’s 2012 “London’s Picture of Sustainability” Photography Competition (the Competition) is Caydoo Limited whose registered offices are at 16 Maddox Street, Mayfair, London, W1S 1PH (the Promoter).

Eligibility

1.1           Open to registered members of Caydoo.com over the age of 18 only. Employees of the Promoter or any associated company and their immediate family as well as sponsors of the Competition and their employees and judges and their immediate family, or anyone else involved in the organisation of the Competition, may not enter the Competition.

1.2           Entrants must not be professional photographers. For the purposes of this Competition, a professional photographer is considered to be someone who makes more than half their annual income from the sale of their photographs.

How to enter

1.3           The Competition is free to enter for registered and eligible members of Caydoo.com.

1.4           To enter the Competition visit www.apictureofsustainability.com/enter and submit one photograph, in accordance with the Entry Requirements listed below, that you believe sums up “sustainability” within London.

1.5           Entries that do not comply with the Entry Requirements will not be valid.

1.6           Only one entry is permitted per person. In order to verify that only one photograph is entered per person, you will be required to enter your Caydoo username at the time of submission.

1.7           The closing date is midnight (GMT) on 22/07/2012. Entries received after this date will not be valid.

Prizes

1.8           The prizes available to be won are:

1.8.1               Overall Winner:  One winner will win a 3 holidays at Canopy & Stars places. The stays are available at the following places during the following dates:

1.8.2               The winner will have a choice of staying in either the House of Straw or Hobbit House roundhouse at Plan-it-Earth, Cornwall as a 4 night mid week break (Mon to Fri) stay with check in dates between 1 March 2013 and 31 May 2013 (excluding Easter and bank holidays).

1.8.3               The winner can choose from a tipi or yurt at Wild Northumbrian Tipis and Yurts for a 3 night weekend (Fri to Mon) or 4 night mid week (Mon to Fri) stay with check in dates between 1 June 2013 to 31 August 2013 (excluding bank holidays).

1.8.4               The winner will stay at Mount Hall Yurt for a 3 night weekend (Fri to Mon) or 4 night mid week (Mon to Fri) with check in dates between 1 September 2013 and 31 October 2013.

1.8.5               People’s Choice Prize:  The winning entry as voted for by the online poll, will win a 3 night weekend (Fri to Mon) or 4 night mid week (Mon to Fri) stay at Westley Farm, Cotswolds, with a choice of 4 yurts, with check in dates between 1 April 2013 to 30 September 2013 (excluding August and bank holidays).

1.8.6               Voter’s Prize:  One winner drawn from all those who voted in the online poll will win a 3 night weekend (Fri to Mon) or 4 night mid week (Mon to Fri) stay at Annie’s Wagon, Cornwall, with check in dates between 1 April 2013 to 30 September 2013 (excluding August and bank holidays).  They will also receive a “Little Green Bag” gift bag and a Spa Treatment at a venue on King’s Road, London courtesy of Lush Cosmetics.

1.8.7              All stays are on a self-catering basis and the number of guests available to stay at each site is as per the booking terms outlined on the Canopy & Stars website. Travel to the prize destination(s) is not included.

1.9           Prizes will be awarded at an Award Ceremony to be held at a venue TBC on August 22nd 2012.

1.10        Winners, or a nominated representative, must be present at the Award Ceremony on 22/08/12 at the venue TBC in order to claim their prize. If a winner does not attend the Award Ceremony then that individual forfeits their right to receive that prize and the prize will lapse.

1.11        If a winner is unable to claim their prize, or it is declined, it will not affect that individual’s right to be named as Overall Winner, Runner Up or the People’s Choice Award Winner nor will this affect that individual’s duties to comply with these terms and conditions including those relating to winner’s publicity.

1.12        Prizes are non-transferable and the winner cannot request any alternative prize (cash or otherwise).

1.13        In the event of circumstances outside of its reasonable control, the Promoter reserves the right to substitute a prize for one of equal or greater value.

Winner Selection and contact

1.14        An Overall Winner, People’s Choice Award Winner and Voter’s Winner will be selected from all complete and valid entries received before the Closing Date in accordance with the following judging process:

  • Stage One: All valid entries received before the Closing Date will be shortlisted to 100 by a panel of independent photography students at the London Metropolitan University.
  • Stage Two: An independent panel of Judges (the Judges) will then select 50 images from the shortlist of 100 to be submitted to Stage Three as finalists. The Judges shall have absolute discretion to consider all valid entries to the Competition and include them within the shortlist even where an entry may have been rejected at Stage One.
  • Stage Three: The 50 finalist entries selected by the Judges at Stage Two shall be printed, mounted and exhibited at a venue TBC in London. The finalists will also be exhibited online at [www.apictureofsustainability.com] where registered Caydoo members can vote for the winner of the People’s Choice Award.  The Judges will select an Overall Winner from the 50 finalists.

1.15        In the event that less than 100 valid entries are received, the Judges will select a shortlist of 50 finalists. The 50 finalist entries shall be printed, mounted and exhibited in London. The entries will also be exhibited online at www.apictureofsustainability.com where registered Caydoo members can vote for the winner of the People’s Choice Award. The Judges will select an Overall Winner and Runner Up from the 50 finalists.

1.16        The Judges’ decision is final. The full names of all judges are available on written request to 16 Maddox Street, Mayfair, London, W1S 1PH. No correspondence will be entered into in respect of any decision made in connection with this competition.

1.17        The entries will be judged on the following criteria: Photographic skill and composition;  interpretation of “Sustainability” and how it pertains to London;  Subject matter.

1.18        The People’s Choice Award Winner will be the photograph with the most votes received by midnight GMT on August 22nd, 2012. Each Caydoo member may vote only once and must provide their Caydoo username at the time of voting on www.apictureofsustainability.com. Multiple votes from the same Caydoo member will be rejected.

1.19        The results of the Competition will be announced on www.apictureofsustainability.com on August 23rd, 2012.

1.20        In the event that either the Overall Winner or Runner Up and the People’s Choice Award Winner are the same, then the Promoter reserves the right to award the People’s Choice Award to the finalist with the next highest number of votes.

1.21        The Overall Winner, Runner Up and People’s Choice Award Winner will be notified by email within 7 days of the results being announced using the contact details provided at the time of entry.

Winner publicity

1.22        The name, county and entry of the winners will be published on www.apictureofsustainability.com from 23/08/12.

1.23        You agree that if you are a finalist or a winner you will take part in and co-operate fully with all reasonable publicity accompanying or resulting from this promotion without further recompense.

Entry requirements

1.24        The Competition asks photographers to capture what they believe sums up “Sustainability” within London in just one photograph.

1.25        All photographs must be taken within the boundaries of the M25 Orbital and must be accompanied by a title and caption of a cumulative total of no more than 60 words that explains how and why their image relates to “Sustainability” and where it was taken. It is left to the individual to interpret “Sustainability” for these purposes.

1.26        All entrants will be asked to declare at the time of entry that the images they are submitting comply with the Competition rules and that the picture information they provide is complete, true and accurate.

1.27        Before submitting an entry, entrants must not have offered their entry for sale, been paid for publication of their entry, or have won or been runner up in any other photographic competition with their entry.

1.28        Entries must be digital images or scans of transparencies (any format). Poor quality scans will be rejected at the Promoter’s sole discretion. Transparencies and prints are not permitted. Black and white images are acceptable.

1.29        Entries should initially be submitted at www.apictureofsustainability.com as JPEG or TIFF files with a maximum file size of 5MB. If an entry is successful in being shortlisted at Stage One of the judging process (see “Winner Selection and contact” above), the Promoter will request the original file for that entry from the entrant for further judging and reproduction purposes with no interpolation applied.

1.30        Images submitted for the shortlist at Stage One of the judging process must be of sufficient quality and resolution to produce high quality large-scale A2 prints from. If an entrant is unable to provide a suitable original file, the entry may be disqualified at the Promoter’s sole discretion.

1.31        There are no restrictions on the type of camera used but it should be noted that part of the judging criteria will be technical excellence and it is therefore recommended that entrants use the highest possible quality settings. The original file should be as large as can be achieved with the equipment available to the entrant. The image should have been taken using a camera with sufficiently high resolution to allow the image to be printed at A2 size for the purposes of exhibition.

1.32        As a general principle, entries should be a faithful representation of what was captured at the time of the photograph being taken. Digital adjustments are only acceptable if limited to minor cleaning work (for example removing dust spots), levels, curves, colour, saturation and contrast work. Sharpening and minimal cropping is permitted as is dodging, burning and toning.

1.33        Stitched images are not permitted. Compositing, multiple exposures, sandwich shots and double exposures are not permitted. Adding or removing elements into/from the image is not allowed.

1.34        Pictures that have been digitally manipulated beyond the extent as set out in these terms and conditions will be disqualified. The Promoter reserves the right to exclude any image that its sole opinion is considered to have been excessively altered or treated.

1.35        Any entries that are deemed by the Promoter to be obscene, vulgar, pornographic, hateful, threatening, discriminatory or otherwise bring the Competition into disrepute will be excluded from the Competition.

Use and display of entries and copyright

1.36        The copyright of the entry must belong to the entrant. Entrants will retain copyright in the photographs they submit. Entrants must not have infringed the rights of any other party or breached any laws when taking their photograph. If a photograph contains an image of a person, the consent of that person (or their parent or guardian if they are under 18) must have been obtained.

1.37        By submitting an entry, you licence and grant the Promoter, its affiliates and sub-licensees an exclusive, royalty free, perpetual, worldwide, irrevocable and sub-licensable right to use, reproduce, modify, adapt, publish and display such content for any purpose in any media including, but not limited to:

(a)                     the Promoter’s website, marketing materials, newsletters and posters;

(b)                     a calendar; and

(c)                     publishing and publicly exhibiting the entry

without further compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use where the moral rights in respect of the content are yours to assert. You warrant that the materials are your original works, have not been copied, in whole or in part, from any third party and you have full authority to grant these rights.

1.38        Every reasonable effort will be made by the Promoter to credit the entrant but no guarantees are made in this request.

1.39        Third parties will not be granted permission to use images for any other purpose other than in accordance with these terms and conditions without express permission from the entrant.

1.40        Subject to contract and the express permission of the entrant, prints of the finalist entries will be available to purchase via [www.website.com] and any profit made from an entrants photograph in this respect will be split equally between the Promoter and the entrant.

1.41        Entries will not be returned.

Liability

1.42        Except for death or personal injury caused by negligence of the Promoter or Canopy & Stars, their employees or agents, neither the Promoter, Canopy & Stars, their employees nor their agents assume any responsibility for:

1.42.1            any system failures of the website or third party websites;

1.42.2            any failure to fulfil obligations of any third parties involved in this Competition;

1.42.3            loss or non-delivery of prizes or entries sent by post;

1.42.4            Any fault, malfunction, damage, loss or disappointment suffered by the participants in the Competition howsoever arising from participating in the Competition;

1.42.5            communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Competition;

1.42.6            Inaccessibility or unavailability of the internet or the website or any combination thereof through dial up, broadband, mobile internet or WAP connections;

1.42.7            Any injury or damage to a participant’s or to any other person’s computer which may be related to or resulting from any attempt to participate in the Competition;

1.42.8            If for any reason the Competition or any Competition website is not capable of running as planned for reasons which may include without limitation, infection by computer, virus, tampering, unauthorised intervention, fraud, technical failures or any other causes which may corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition; and

1.42.9            Any other matter outside of the Promoter’s reasonable control.

General

1.43        If deemed necessary the Promoter reserves the right to cancel, modify or extend or suspend the Competition.

1.44        The Promoter reserves the right to modify these terms and conditions at any time on giving notice through its website at www.apictureofsustainability.com;

1.45        By entering the Competition you:

1.45.1            accept these terms and conditions; and

1.45.2            accept the use of your personal data by the Promoter: (a) for the purpose of administration of the Competition (including publishing your name and county if you are the winner); and (b) in accordance with terms of the Privacy Policy); and (c) any other purposes to which you have consented.

1.46        The Promoter’s decision will be final and no correspondence will be entered into in respect of all matters to do with the promotion.

1.47        The Promoter reserves the right to exclude any entry from the Competition if they deem it to be ineligible or otherwise invalid and the Promoter shall have complete discretion in this respect.

1.48        No responsibility can be accepted for lost entries or incomplete entries. Proof of entry is not proof of receipt.

1.49        This promotion is governed by English law and subject to the exclusive jurisdiction of the English Courts.
